Terms of Service

These Terms of Service ("Terms") govern your use of the Falcon X VPN mobile application (the "App"), provided by Falcon X VPN, operating as Falcon X VPN ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using Falcon X VPN, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Eligibility

You must be at least 13 years of age to use Falcon X VPN. If you are between 13 and the age of majority in your jurisdiction, you must have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these eligibility requirements.

3. Service Description

3.1 VPN Service

Falcon X VPN provides a virtual private network (VPN) service using Android's VpnService. When connected, your device's network traffic is routed through an encrypted tunnel to our remote servers. The service is provided on an "as is" and "as available" basis.

3.2 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted, error-free, or fixed-speed service. Service may be interrupted for maintenance, upgrades, network conditions, or events beyond our reasonable control. We reserve the right to modify, suspend, or discontinue any aspect of the service with reasonable notice where practicable.

3.3 Server Nodes and Features

The availability, location, and number of VPN server nodes may change over time. We may add, remove, or modify nodes and features at our discretion. Material changes that affect your experience will be communicated with reasonable notice through the App.

4. User Conduct and Prohibited Activities

You agree not to use Falcon X VPN for any of the following:

• Illegal Activities: Any activity that violates applicable local, state, national, or international laws or regulations.
• Attacks and Exploitation: Launching or facilitating denial-of-service attacks, network intrusions, port scanning, or any activity that compromises the security or integrity of any network, system, or service.
• Spam and Unsolicited Communications: Sending spam, bulk unsolicited messages, phishing attempts, or other forms of abusive communication.
• Resource Abuse: Excessively consuming network resources in a manner that degrades service for other users.
• Quota Circumvention: Attempting to bypass, manipulate, or circumvent the free data allowance system, including use of device identifiers designed to reset quotas artificially.
• Resale and Redistribution: Reselling, sublicensing, renting, or otherwise making the VPN service available to third parties without our express written permission.
• Service Disruption: Interfering with the proper functioning of the App, its backend infrastructure, or other users' experience.
• Intellectual Property Infringement: Using the service to infringe upon copyrights, trademarks, patents, or other intellectual property rights.

We reserve the right to investigate and take appropriate action against any user who violates these prohibitions, including suspension or termination of service access and cooperation with law enforcement authorities.

5. Free Service

5.1 Free Data Allowance

Free users receive 2 GiB (2,147,483,648 bytes) of VPN data per 24-hour rolling cycle. The cycle begins upon your first data usage and resets automatically 24 hours thereafter. Unused data does not carry over to the next cycle.

5.2 Data Allowance Enforcement

When your free data allowance is exhausted, your VPN connection will be automatically disconnected. You may reconnect after your data allowance resets or by upgrading to a Premium subscription. We reserve the right to adjust the free data allowance amount with reasonable notice.

6. Premium Subscription

6.1 Subscription Plans

Premium subscriptions are available on a weekly, monthly, or annual basis. Current pricing and plan details are displayed within the App and on Google Play. All prices are subject to change with notice.

6.2 Automatic Renewal

Premium subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Google Play account will be charged for renewal within 24 hours prior to the end of the current period.

6.3 Cancellation

You may cancel your Premium subscription at any time through your Google Play account settings under Subscriptions. Upon cancellation, your Premium benefits remain active until the end of the current billing period. No partial refunds are provided for unused portions of the billing period, except as required by applicable law.

6.4 Restoring Purchases

If you reinstall the App or switch devices, you can restore your active Premium subscription through the "Restore Purchases" option in the App settings. Restoration is linked to your Google Play account, not your device.

6.5 Refunds

Refund eligibility and processing are governed by Google Play's refund policies and applicable local consumer protection laws. We do not directly process refunds. For refund requests, please follow Google Play's refund process or contact our support team for assistance.

6.6 Pricing and Plan Changes

We reserve the right to modify subscription pricing and available plans. Price changes for existing subscribers will be communicated with reasonable advance notice and will take effect at the next renewal date. Continued use after a price change constitutes acceptance of the new pricing.

7. Device Identity and Account Management

7.1 Anonymous Identity

Falcon X VPN identifies your device through an anonymous identifier (Android ID and a backend-generated user ID) without requiring registration or personal account creation. This identifier is used solely for service delivery, quota management, and abuse prevention.

7.2 Device Changes

If you switch to a new device, your anonymous user profile (including usage history and free data allowance status) does not automatically transfer. Premium subscriptions, however, are linked to your Google Play account and can be restored on a new device.

7.3 Suspension and Termination

We reserve the right to suspend or terminate your access to the service, without prior notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive behavior, or if your use poses a risk to our infrastructure or other users. In cases of suspension due to abuse, we may revoke the ability to reconnect from the flagged device identity.

8. Intellectual Property

The App, including its name ("Falcon X VPN"), logo, design, user interface, code, and all associated intellectual property, is owned by us or our licensors. These Terms do not grant you any rights to our intellectual property beyond the limited right to use the App as described herein. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works of the App without our prior written consent.

9. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the service will be uninterrupted, error-free, secure, or available at any particular time or location.
• Warranties regarding the accuracy, reliability, or completeness of any information provided through the service.
• Warranties that any defects or errors will be corrected.

Falcon X VPN is a tool for enhancing online privacy; it does not guarantee complete anonymity or security. You are responsible for your own online activities and compliance with applicable laws.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, FALCON X VPN AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, or goodwill.
• Service interruption, computer damage, or system failure.
• Cost of procurement of substitute services.
• Damages arising from your use of or inability to use the App.
• Unauthorized access to or alteration of your transmissions or data.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY US DOLLARS ($50.00), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Falcon X VPN and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• Your violation of these Terms.
• Your use of the App in violation of applicable laws or regulations.
• Your infringement of any third-party rights.

12. Third-Party Services

The App integrates with third-party services, including Google Play Billing, RevenueCat, and Google AdMob. Your use of these services is subject to their respective terms and policies. We are not responsible for the content, functionality, or practices of third-party services.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the App and update the "Effective Date" above. In the event of significant changes, we may require you to re-confirm your acceptance before continuing to use the App. Your continued use of the App after the effective date of modified Terms constitutes acceptance of the changes.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles.

14.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through informal negotiations. If the dispute cannot be resolved informally, it shall be resolved through binding arbitration in San Francisco County, California, in accordance with the rules of the American Arbitration Association. You agree to resolve disputes on an individual basis and waive any right to participate in a class action or class-wide arbitration.

15. Termination

These Terms remain in effect until terminated by either party. You may terminate these Terms at any time by discontinuing use of the App and deleting it from your device. We may terminate these Terms and your access to the service at any time for violation of these Terms or for any other reason, with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination (including Sections 8–12, 14, and 16) shall survive.

16. General Provisions

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Falcon X VPN regarding the App.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
• Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
• Force Majeure: We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control.
